If I were you. I would make sure the old fence is your land or his land or the middle.

He can build another fence in his land close to yours;

If the fence is in the middle of both land, means you two both own the fence. In that case, you have to either repair or replace or remove the fence together with your neighbor. You may not need to pay for the new fence if you do not agree, but you most probably have to pay for the removing old unsafe fence...
