新房找律师必要性到底有多少?!

老杨团队,追求完美;客户至上,服务到位!
价格刚谈拢,正在办mortgage的相关事宜,builder说用他们请的律师就行,我们买放到底是否需要格外请自己律师呢?

新房都有质量保证一年。我没有找自己的律师,用builder律师。

很必要如果你是个很计较的人。因为Builder肯定会犯很多小错,用他的律师基本就不会怎么维护你的利益的。

7 J6 i. R: U  k" |# g+ B反正2,3年后来会换房子所以我就用了Builder的律师。到Build我dream house的时候会用自己的律师。

如果真在意合约,给律师的钱也不会太多2,3千够了。我同事也就给了2千。

问了几家,要么2000,要么一千,肿么差距就那么大嘞?

正常人的思维是:必要性非常大,不知道经过马桶上的思考是否大打折扣了?

这个律师只是做新房过户,MORTGAGE等等。所以花钱找自己滴律师纯粹浪费千吧银子

我也这么觉得,要么就请个贵的,在合同方便好好争取一下,要么就认命!

合同都是固定的,可能有些条件会有不同,大同小异,感觉律师不会争取太多,价格就全靠你自己争取了。

Builder找得律师只是负责过户;如果将来真出了任何问题,这个律师是不会负责任何一方的,二方都会各找个律师处理官司。

所以大部分人都是用builder提供的律师。

I would suggest hiring a lawyer just to be on the safe side.  ' Y! L+ u1 D- C! y  v" ]

' V4 z+ g/ G' E. {9 c0 ja breakdown of what the Lawyer's tasks are:

1. they will order a title search. This title search ensures that the seller is really the seller and proper owner of that property.
7 f5 D7 K; [2 o: r2. they will search for any outstanding legal claims or liens against the property you are buying./ {+ H  @# T* V; k) z
3. they will ensure that there are no property taxes outstanding against the property.- V9 U; S7 t4 N  ^
4. they will handle the ownership transfer, from the seller to the buyer (in direction communication with the lawyer representing the seller) and ensure that the mortgage is properly registered to the new owner, with the Registrar's Office (note that this is usually done electronically now, by the lawyer).
) A4 j0 Y- D; Q7 z6 T5. they will verify all mortgage documents received from your lender and will ensure you as the borrower can fulfill all terms and conditions as stated in that mortgage agreement (for example, the lender may have asked that certain credit card debts be paid off in full, prior to closing, and there are many other examples of special mortgage lender conditions).
3 N/ K( _6 Y# K6 H# `% \9 o6. they will make sure that the proper funds are in place to close your mortgage.
8 v$ _# i- u: d. b7. they will make arrangements with you, typically a few days before closing date to sign all the legal documents with you and they will also explain everything about the transaction and note that you only get your key on closing day.6 _/ [" G" \8 g7 _& q
8. they will let you know how much remaining funds (that are not being provided by the mortgage lender) that you need to bring into their office to make up the down payment in a certified cheque or money order.9 _2 V5 W/ v% E/ y+ C( I& r+ ~
9. you and all other applicants will be required to present Identification to confirm who you are.; b8 ~2 f" o! N. z
10. the lawyer will also look at your fire insurance documents to ensure you have proper insurance coverage, as requested by the mortgage lender, and will contact that insurance company to ensure that the lender's interests are properly documented in that policy.
# z: V4 R+ \+ G$ p1 U+ ~11. the lawyer is fully responsible for disbursement of funds, therefore, all monies regarding the transaction(s) must be documented in a proper reconciliation statement for the client(s) and the lawyer moves funds as necessary.

; E* B% i9 U8 X5 \/ w, F& ?最关键的是万一你和你的builder有了法律冲突(虽然可能性不大),如果你不自己另请律师,替你写合同的人就变成了你的对手。
