Google Condominium Act Alberta. According to this legislation, the Condo Board has legal rights to determine condo fee and levy special assessment. If in arrears, the Condo Board can sue, can ask the owner's lender to pay (simply showing documents to prove unpaid fee, the Bank will do due diligence of course, Bank can foreclose the owner if the Bank feels absolutely necessary). At the same time, the Board can go down to Land Title Office, register a caveat against your home Certificate of Title, impeding any sale of the property (no one would risk buying a property with that caveat). |
